If Pexel Marketing does take any legal action against you as a result of your violation of these Terms of Use, Pexel Marketing will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to Pexel Marketing You agree that Pexel Marketing will not be liable to you or any third party for termination of your access to the Site as a result of any violation of these Terms of Use.
You agree to abide by Pexel Marketing’s copyright infringement claims policy. You also agree that Pexel Marketing may, in its sole discretion and without prior notice, disable or deactivate all, or relevant portions of, your Site alleged to violate the Pexel Marketing copyright infringement claims policy. All Pexel Marketing customers whose content is disabled or deactivated will receive a notice of copyright infringement, and may provide Counter Notification by emailing info@pexelmarketing.com and including the following: a) an electronic signature of the Customer; b) identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled; and c) a statement under penalty of perjury that the Customer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled, and stating the reasons for this belief. Upon receipt of a Counter Notification, as described above, Pexel Marketing shall promptly provide the Complaining Party with a copy of the Counter Notification, and inform such Complaining Party that it will replace the removed material or cease disabling access to it in ten (10) business days. Pexel Marketing will replace the removed material and cease disabling access to it not less than ten (10), nor more than fourteen (14), business days following receipt of the Counter Notification, unless Pexel Marketing first receives notice from the Complaining Party that such Complaining Party has filed an action seeking a court order to restrain the Infringer from engaging in infringing activity relating to the material on Pexel Marketing system or network.
9. Limitation of Liability

Our aggregate liability for all claims relating to the service shall not exceed the amounts paid by the client for the past three months of the service in question.
